Collaborator Terms of Use

Version 1.0

These Content Submission and Collaboration Terms (“Content Terms”) apply to any photos, videos, audio, graphics, captions, usernames, handles, comments, or other materials (collectively, “Content”) that you submit or make available to Omaha High School Sports, L.L.C. d/b/a OmahaHSSports (“OmahaHSSports,” “we,” “us,” or “our”) in any way, including but not limited to:

Inviting @OmahaHSSports to collaborate on Instagram or other social platforms
Tagging @OmahaHSSports in posts or stories
Sending Content to us via direct message, email, upload form, or any other method
Using #BraskaSports or any hashtag or method that we specifically identify as a way to submit Content to us

By doing any of the above, you agree to these Content Terms in addition to our main Terms of Use and Privacy Policy available at OmahaHSSports.com.

1. License you grant to us

You hereby grant OmahaHSSports a perpetual, irrevocable, worldwide, non-exclusive, transferable, sublicensable, royalty-free license to:

Use, reproduce, display, perform, distribute, transmit, and publish the Content
Edit, crop, adapt, modify, combine, and create derivative works from the Content
Use the Content in any media or format, whether now known or later developed, including but not limited to social media, websites, apps, broadcasts, streams, print, and advertising
Monetize the Content in any lawful way, including through ads, sponsorships, subscriptions, licensing, or other commercial uses

This license is granted without any obligation for us to credit you, pay you, seek additional approval from you, or notify you before we use the Content.

2. No expectation of payment or usage

You understand and agree that:

We are not required to use any Content you submit.
You are not entitled to any payment, royalties, or other compensation for our use of the Content, unless we have a separate written agreement that explicitly says otherwise.
We may remove or stop using the Content at any time, for any reason, without notice.

3. Your promises to us (representations and warranties)

By submitting Content or inviting us to collaborate, you represent and warrant that:

You own the Content or otherwise have full rights and authority to grant us the license described in these Content Terms.
You have obtained all necessary permissions from any individuals, schools, event organizers, rights holders, or other parties who appear in or have rights in the Content, including for commercial use.
The Content does not infringe or violate any copyright, trademark, privacy, publicity, or other rights of any third party.
The Content does not violate any school, league, conference, state association, or facility rules that apply to you.
If any individuals in the Content are minors, you have obtained all required permissions from their parent or legal guardian and from any applicable school or organization that controls their media rights, to grant us the license described here.
The Content is not unlawful, defamatory, harassing, obscene, hateful, or otherwise in violation of our Acceptable Use terms.

If you are under the age of nineteen (19), which is the age of majority in the State of Nebraska, you may only submit Content, tag us, invite @OmahaHSSports to collaborate, or otherwise participate in any method of Content submission with the knowledge and express consent of your parent or legal guardian.

By submitting Content in any way, you represent and warrant that:

Your parent or legal guardian has reviewed these Content Terms and has agreed to them on your behalf, and
You have obtained all necessary permissions from your parent or legal guardian for OmahaHSSports to use the Content as described in these Content Terms.

If you cannot make these representations truthfully, do not submit Content to us.

4. Credit and tagging

We may, but are not required to:

Tag your account
Identify you by name or handle
Provide any other attribution

Any credit or tagging is at our sole discretion and may be changed, removed, or omitted at any time.

5. Release of claims

To the maximum extent permitted by law, you:

Release and discharge OmahaHSSports and its owners, officers, employees, contractors, agents, sponsors, partners, and assigns from any and all claims and demands arising out of or relating to our use of the Content, including without limitation claims for infringement of rights of publicity, privacy, intellectual property, or moral rights.
Agree that you will not sue or bring any claim against us based on our use of the Content as permitted by these Content Terms.

6. Indemnity

You agree to indemnify, defend, and hold harmless OmahaHSSports and its owners, officers, employees, contractors, agents, sponsors, partners, and assigns from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Any breach by you of these Content Terms
Any claim that the Content infringes or violates any third-party rights
Any claim related to individuals or property depicted in the Content

7. Relationship to our main Terms of Use

These Content Terms are in addition to our main Terms of Use and Privacy Policy posted at OmahaHSSports.com.

Any dispute relating to these Content Terms or our use of the Content will be handled in accordance with the dispute resolution, limitation of liability, and other legal provisions in our main Terms of Use, which are incorporated here by reference.

If you do not agree to these Content Terms, do not invite us to collaborate, do not tag us, and do not submit any Content to us.

8. Governing Law

These Content Terms are governed by the laws of the State of Nebraska, without regard to its conflict of laws principles. Any dispute arising from or relating to these Content Terms, to the extent not subject to arbitration under our main Terms of Use, shall be brought exclusively in the state or federal courts located in Nebraska, and you consent to the personal jurisdiction of those courts.
